a. The following General Terms and Conditions shall apply to all contracts, deliveries and other services of NEIDFAKTOR Manufaktur GmbH, Ludwig-Meyn-Straße 18, 25469 Hamburg, Germany, telephone number: +49 (0) 4101 8580830, e-mail address: [email protected] (hereinafter referred to as NEIDFAKTOR) via this online shop.
b. Any deviating provisions of yours shall not apply unless NEIDFAKTOR has expressly confirmed this in writing.
c. The business relations between NEIDFAKTOR and you are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
d. The place of jurisdiction is Hamburg, Germany, insofar as you are a merchant or have no general place of jurisdiction in Germany.
e. Agreements made with you in individual cases (including ancillary agreements, supplements and amendments) shall in all cases take precedence over these terms and conditions.
f. The languages available for the conclusion of the contract are German and English. In case of doubt about the interpretation of contracts, declarations of intent or other declarations, the German language shall prevail.

a. The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. Before submitting your binding order, you can correct all entries on an ongoing basis using the usual keyboard and mouse functions. In addition, all entries are displayed again in a confirmation window before the binding submission of the order and can also be corrected there using the usual keyboard and mouse functions. Deviations and technical changes compared to the illustrations or descriptions are possible. By clicking the order button “buy now”, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of the order will be sent immediately after the order has been sent. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within five days, unless you have chosen the payment method PayPal. In that case, the contract is concluded in any case at the time of confirmation of the payment instruction with the payment service provider.
b. With the notification of the conclusion of the contract, you will receive the text of the contract, these GTC and the cancellation policy by e-mail. You can also view and download the GTC and the cancellation policy at any time on this page. You can view your past orders in your customer account.
All prices include the statutory value added tax, unless there is a VAT-exempt intra-Community delivery or a delivery to a third country. The prices quoted do not include shipping and packaging costs, which will be notified to you before placing the order and on this page under:
Delivery & Shipping
The indication of the delivery period refers to the period between order and delivery, in the case of advance payments as the period between payment and delivery.
The availability of the individual goods is indicated in the item descriptions. For goods designated as “in stock” in the online shop, the delivery period is 8 working days from the conclusion of the contract, unless otherwise stated in the item description (in the case of payment in advance by bank transfer: 6 working days from receipt of payment by the customer). If non-compliance with a delivery or performance deadline is due to force majeure, industrial action, unforeseeable obstacles or other circumstances for which NEIDFAKTOR is not responsible, the deadline shall be extended accordingly. We only deliver by dispatch. It is not possible to collect the goods yourself. We do not deliver to packing stations.
There are no other price components.
a. Payment shall be made by advance payment or PayPal as follows:
Prepayment: If you select the prepayment method, we will provide you with our bank details in the order confirmation. Payment is due immediately after conclusion of the contract. We will deliver the goods after receipt of payment.
Paypal: You pay the invoice amount via the online provider PayPal. You must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us (exception: guest access). You will receive further instructions during the ordering process.
b. NEIDFAKTOR will always issue you with an invoice which will be handed over to you on delivery of the goods or otherwise sent to you in text or electronic form. You agree to this.
c. The goods remain the property of NEIDFAKTOR until payment has been made in full.
d. You shall only have the right to set-off if your counterclaims have been recognised by NEIDFAKTOR or have been legally established.
a. The ordered goods will be delivered to the address provided by you, unless otherwise agreed in the contract. Delivery will be made from NEIDFAKTOR’s warehouse.
b. NEIDFAKTOR reserves the right to make a partial delivery if this appears to be advantageous for a speedy processing and the partial delivery is not exceptionally unreasonable for you. You will not be charged for any additional costs arising from partial deliveries.
c. The stated delivery period is non-binding, unless NEIDFAKTOR has exceptionally promised a binding delivery date. Goods in stock will be dispatched by NEIDFAKTOR within three working days of receipt of your payment, unless otherwise expressly agreed.
d. The risk of accidental loss and accidental deterioration of the goods shall pass to you at the latest when the goods are handed over. If you are an entrepreneur, the risk of accidental loss and accidental deterioration of the goods as well as the risk of delay shall pass to you upon delivery of the goods to the forwarding agent, the carrier or any other person designated to carry out the shipment.
If goods are delivered with obvious transport damage, please complain about such defects to the delivery company as soon as possible and contact NEIDFAKTOR immediately. Failure to make a complaint or to contact us has no consequences for your legal claims and their enforcement, especially warranty rights. However, it helps us to be able to assert our own claims against the carrier or transport insurance.
All goods from our shop are subject to statutory warranty rights with the following proviso:
a. If only merchants are involved in the contract, §§ 377 ff. HGB (GERMAN COMMERCIAL CODE) SHALL APPLY.
b. If there are defects and these have been asserted in good time, NEIDFAKTOR shall be obliged to provide supplementary performance. If the supplementary performance fails, you are entitled to reduce the purchase price or to withdraw from the contract.
c. Damage caused to the goods themselves or to your own property by your improper actions during installation, connection, operation, storage or use of the goods shall not constitute grounds for any warranty or liability claim against NEIDFAKTOR.
d. NEIDFAKTOR shall also be liable for the slightly negligent breach of essential obligations (obligations whose breach jeopardises the achievement of the purpose of the contract) as well as for the breach of cardinal obligations (obligations whose fulfilment makes the proper execution of the contract possible in the first place and whose fulfilment you regularly rely on), but in each case only for the foreseeable damage typical for the contract. NEIDFAKTOR shall not be liable for the slightly negligent breach of obligations other than the above.
e. If NEIDFAKTOR’s liability is excluded or limited, this shall also apply to the personal liability of its employees, representatives and vicarious agents.
f. The limitations of liability in the preceding paragraph do not apply in the case of injury to life, body and health, for a defect following the assumption of a guarantee for the quality of the product, in the case of fraudulently concealed defects and in the case of intent and gross negligence. Liability under the Product Liability Act shall also remain unaffected.
g. You must notify NEIDFAKTOR of any defects within a warranty period of two years for new items or one year for used items. If you are an entrepreneur, the warranty period for new items is one year. In the case of used goods, the warranty against entrepreneurs is excluded.
